These Terms and Conditions constitute a legally binding agreement between you and Westport Property. By accessing or using this Website, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must cease using this Website immediately. This document is governed exclusively by Scots Law.

All patents, rights to inventions, copyright and related rights, trade marks and service marks, trade names, domain names, rights in designs, rights in computer software, database rights, rights in confidential information, and all other intellectual property rights, whether registered or unregistered, anywhere in the world. |

Acceptance of Terms

Agreement to Terms
By accessing, browsing, or using the Website in any manner, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and all applicable laws and regulations, including but not limited to the Consumer Rights Act 2015, the Electronic Commerce (EC Directive) Regulations 2002, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and all relevant Scottish legislation.

Capacity to Contract

Tenancy-related records are typically retained for a minimum of six years following the end of a tenancy in accordance with the Prescription and Limitation (Scotland) Act 1973. Whilst Westport Property takes all reasonable care to ensure that Listing Content is accurate, complete, and up to date at the time of publication, we cannot guarantee its continued accuracy and expressly exclude all warranties in this regard.

No Reliance on Listings
Listing Content does not constitute a formal offer, invitation to treat, or legal commitment of any kind. You must not rely on any Listing Content as a substitute for your own independent enquiries. Before entering into any tenancy or property transaction, you are strongly advised to:

Scottish Tenancy Law Compliance
All residential lettings facilitated by Westport Property in Scotland are subject to the Private Housing (Tenancies) (Scotland) Act 2016. Key legal requirements that apply to properties listed by us include:
- All landlords must be registered with their local council under the Landlord Registration (Scotland) Act 2004. Westport Property will verify registration prior to marketing any property.
- All private residential tenancies created on or after 1 December 2017 must be constituted as Private Residential Tenancies (PRTs) on the Scottish Government’s model tenancy agreement.
- Properties must meet the Repairing Standard as defined in the Housing (Scotland) Act 2006 (as amended), and landlords must ensure that all repair obligations are fulfilled prior to let and throughout the tenancy.
- Landlords are required to comply with the Tolerable Standard and relevant housing legislation.
- All relevant gas safety, electrical safety (EICR), energy performance certificate (EPC), and Legionella risk assessment obligations must be fulfilled.
- Any deposit taken from a Tenant must be registered with an approved Tenancy Deposit Scheme within 30 working days of receipt.
- The Letting Agent Code of Practice (Scotland) Regulations 2016 apply to all letting agency activities conducted by Westport Property. A copy of our Letting Agent Registration Number is available on request.

Energy Performance Certificates
All properties advertised for letting on the Website will display a current Energy Performance Certificate (EPC) rating as required by the Energy Performance of Buildings (Scotland) Regulations 2008. It is a legal requirement for a valid EPC to be in place before a property is marketed.

Third-Party Listing Portals
Westport Property may publish property listings on third-party portals, including Rightmove, Zoopla, and OnTheMarket. We are not responsible for the accuracy of listings as reproduced by those platforms, the timing of updates, or for any third-party terms of use applicable to those websites.
Intellectual Property Rights

Ownership
The Website and all Content, including but not limited to text, articles, photographs, floor plans, virtual tours, video content, graphics, logos, design elements, software, and the selection and arrangement thereof, are owned by or licensed to Westport Property and are protected by UK and international copyright, trade mark, database rights, and other applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Website and its Content solely for your own personal, non-commercial purposes in connection with your use of our Services. You may:

General Obligations

Consequences of Breach

- Issue a formal warning
- Commence legal proceedings against you for recovery of all losses and costs (including reasonable legal expenses) incurred as a consequence of your breach
- Disclose your identity and information to law enforcement authorities, regulatory bodies, or other relevant third parties where we are legally required or permitted to do so

Computer Misuse
Any attempt to hack, disrupt, or gain unauthorised access to the Website or its connected systems constitutes a criminal offence under the Computer Misuse Act 1990. We will report any such breach to Police Scotland and will co-operate fully with law enforcement authorities, including by disclosing your identifying information. In the event of any such breach, your right to use the Website will terminate immediately.
Limitation of Liability

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any other matter that cannot be excluded or limited by Scots Law.

Exclusion of Certain Losses

- Any indirect, special, incidental, consequential, or punitive loss

Cap on Liability
Subject to Clause 7.4, our total aggregate liability to you, whether in contract, delict (including negligence), breach of statutory duty, or otherwise, arising under or in connection with these Terms or your use of the Website, shall not exceed the total fees paid by you to Westport Property (if any) in the twelve months immediately preceding the event giving rise to the claim, or £500, whichever is the greater.

Exceptions — Liability Cannot Be Excluded
Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraudulent misrepresentation or fraud
- Any breach of an obligation implied by Section 12 of the Sale of Goods Act 1979 or Section 2 of the Supply of Goods and Services Act 1982
- Any liability that cannot lawfully be excluded or limited under Scots Law or any other applicable mandatory legislation

Force Majeure
We shall not be liable for any failure or delay in performance of our obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including acts of God, natural disasters, pandemic, civil unrest, war, terrorism, failure of telecommunications infrastructure, or any act or omission of a third-party service provider.
Landlord-Specific Terms and Scottish Letting Obligations

Landlord Registration
All Landlords who engage Westport Property to let or manage a residential property in Scotland must be registered with their local council under the Landlord Registration (Scotland) Act 2004 before any marketing activity commences. It is a criminal offence under that Act to let a property without being registered. Westport Property will require proof of registration prior to listing any property.

Letting Agent Registration
Westport Property is registered with the Scottish Government’s Letting Agent Register as required under the Housing (Scotland) Act 2014 (Part 4). Our Letting Agent Registration Number is available on request and displayed on the Website. All letting agency activities carried out by us comply with the Letting Agent Code of Practice (Scotland) Regulations 2016.

Private Residential Tenancy Requirements
All new residential tenancy agreements created on or after 1 December 2017 must take the form of a Private Residential Tenancy (PRT) as provided for under the Private Housing (Tenancies) (Scotland) Act 2016. Westport Property will ensure that all tenancy agreements drafted or administered by us comply with the requirements of the 2016 Act, including the use of the Scottish Government’s model tenancy agreement, the provision of the prescribed information, and compliance with all relevant Prescribed Terms.

Repairing Standard
Landlords are legally obliged under the Housing (Scotland) Act 2006 to ensure that properties let by them meet the Repairing Standard at the commencement of and throughout the tenancy. Landlords who engage Westport Property to manage their property agree to maintain the property in compliance with the Repairing Standard and to authorise Westport Property to commission necessary repairs up to any agreed financial threshold.

Tenancy Deposits
Any deposit received from a Tenant in respect of a Scottish residential tenancy must be lodged with one of the three approved Tenancy Deposit Schemes in Scotland (SafeDeposits Scotland, mydeposits Scotland, or the Tenancy Deposit Scheme Scotland) within 30 working days of receipt, in compliance with the Tenancy Deposit Schemes (Scotland) Regulations 2011. Where Westport Property holds deposits on behalf of Landlords, it will comply strictly with these requirements.

Client Money Protection
Westport Property holds all client money, including rental deposits and rental income collected on behalf of Landlords, in a designated client account, separate from the Company’s own funds. Details of our Client Money Protection scheme membership are available on request.
Tenant-Specific Information and Rights

Pre-Tenancy Information
Prior to the commencement of any Private Residential Tenancy, Westport Property will provide prospective Tenants with all information required by the Private Housing (Tenancies) (Scotland) Act 2016 and any regulations made thereunder, including the Prescribed Information and the current version of the Scottish Government’s Easy Read Notes for the model tenancy agreement.

Fees Charged to Tenants
Under the Tenants’ Rights etc. (Scotland) Act 1980 (as amended), and in compliance with the prohibition on premium charges in residential tenancy law, Westport Property does not charge Tenants any fees, charges, or premiums in connection with the grant, renewal, or continuation of a tenancy, beyond the agreed rent and any permitted deposit. Any charges made to Tenants will be clearly disclosed and will comply with all applicable Scottish legislation.

Tenant Rights Under the PRT Regime
Tenants under a Private Residential Tenancy have significant statutory rights, including but not limited to:
- Security of tenure — a landlord may only end a tenancy on one of the 18 grounds prescribed by the 2016 Act
- Protection from rent increases, which must be effected by proper notice and may be referred to a Rent Officer
- The right to refer disputes to the First-tier Tribunal for Scotland (Housing and Property Chamber)
- Rights in respect of repairs and the Repairing Standard
Westport Property fully supports Tenants in understanding and asserting their legal rights. For further information, Tenants may also consult Shelter Scotland (www.scotland.shelter.org.uk) or Citizens Advice Scotland.
Complaints and Redress

Our Complaints Procedure
Westport Property is committed to providing a high standard of service. If you are dissatisfied with any aspect of our service, please contact us in the first instance by email at info@westportproperty.co.uk or in writing to our registered address. We will acknowledge your complaint within three working days and aim to provide a full written response within 15 working days.

Redress Scheme
As a registered letting agent in Scotland, Westport Property is a member of an approved redress scheme. Details of our redress scheme membership are available on the Website and on request. If you are not satisfied with our final response to a complaint, you may be entitled to refer the matter to the relevant redress scheme in accordance with its rules.

First-tier Tribunal (Housing and Property Chamber)
Tenants and Landlords in Scotland may refer certain disputes, including those relating to the Repairing Standard, tenancy deposits, rent increases, and the grounds for repossession, to the First-tier Tribunal for Scotland (Housing and Property Chamber). Westport Property will comply with any direction or determination made by the Tribunal.
Governing Law and Jurisdiction
SCOTS LAW APPLIES
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the law of Scotland. The parties irrevocably agree that the courts of Scotland shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms or their subject matter or formation.

Choice of Law
These Terms and Conditions shall in all respects be governed by and interpreted in accordance with the law of Scotland. All property transactions facilitated by Westport Property are subject to the applicable Scots Law property legislation, including:
- The Private Housing (Tenancies) (Scotland) Act 2016
- The Housing (Scotland) Act 2006
- The Landlord Registration (Scotland) Act 2004
- The Housing (Scotland) Act 2014
- The Tenancy Deposit Schemes (Scotland) Regulations 2011
- The Letting Agent Code of Practice (Scotland) Regulations 2016
- The Tenants’ Rights etc. (Scotland) Act 1980
- The Land Reform (Scotland) Act 2016 (where applicable to agricultural or community interests)

Jurisdiction
You irrevocably agree that the Scottish Courts shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, whether arising in contract, delict (tort), statute, or otherwise. If you are a consumer habitually resident outside Scotland, mandatory consumer protection provisions of the law of your country of habitual residence may also apply to the extent required by applicable law.

Alternative Dispute Resolution
Before commencing formal legal proceedings, the parties agree to attempt to resolve any dispute by good-faith negotiation. Where applicable, disputes may also be referred to our approved redress scheme or to the First-tier Tribunal for Scotland (Housing and Property Chamber) prior to, or instead of, litigation.
General Provisions

Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from these Terms without affecting the validity and enforceability of the remaining provisions, which shall continue in full force and effect.

Waiver
No failure or delay by Westport Property in exercising any right, power, or privilege under these Terms shall constitute a waiver of that right or any other right. A waiver of any breach of these Terms shall not be deemed to be a waiver of any subsequent breach of the same or any other provision.

Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy (and any additional terms applicable to specific Services), constitute the entire agreement between you and Westport Property with respect to your use of the Website and supersede all prior communications, agreements, and understandings relating to that subject matter. You confirm that, in agreeing to these Terms, you have not relied on any representation not expressly set out herein.

Third-Party Rights
A person who is not a party to these Terms has no right to enforce any of these Terms under the Contract (Third Party Rights) (Scotland) Act 2017 or otherwise.

Assignment
You may not assign, transfer, or sub-contract any of your rights or obligations under these Terms without our prior written consent. Westport Property may assign or transfer its rights and obligations under these Terms to any person at any time without restriction.

Notices
Any notice to be given under these Terms shall be in writing and sent to us at info@westportproperty.co.uk or to the address shown at the head of this document. Notices sent by email shall be deemed received when a read receipt or acknowledgement is returned, or within 24 hours if no delivery failure notification is received.
